Can this be considered slander?

Post  JGH27 on Tue Jul 07, 2009 9:24 pm

Hey, recently had several problems at work. I was not made aware of a very important detail until tonight tho which needless to say has put me on the warpath basically.

Long story short, An employee was short $20 one day so it came out of his pay. He then stole a hundred dollars the following day or 2 after. Simply put Jess is my ex and Tom is her boyfriend.

"Hey Jess,

This message is concerning Tom and an incident where he ditched the ice cream bike while working. From what I was told by Joe (after Canada day) is that he believes I ripped him off $20. I'd just like to say I have never ripped off anyone and would never rip off a rider as I'm well aware how low the pay tends to be. I remember the incident tho and what I believe happened was that in the morning Joe had written down the loads for the bikes. He then transfered it over to a new sheet as a few things changed for a few people. Thsis where I believe the mistake was made. So, if it's anyones mistake it would've been his. I'm not saying he did it intentionally as I don't believe Joe would but I'm sayng it wasn' my mistake. I was told to keep his (Tom's) ice cream aside so Joe could double check it. Whether or not it ever was I am unaware.

The reason I mention this is because I don't want my name dragged through the mud when I'm innocent. If you or Tom have any questions or concerns feel free to reply.

Cheers,
Jeremy"

Their response:

"i still think it was ur fault. but its been dealt with so dont bring it up. just fuck off. ur such a loser and none of us ever wanna hear from u again. so dont ever fucking message me again u peice of shit."

My final remark:

"Has it been dealt with? Way I see it I'm being accused unjustly and was only made ware of it recently. It was never brought to my attention and therefore my name is being slandered. Slander is a criminal offence by the way.

Anyways, I tried to explain what I believe happened but clearly you've got something against me. Have a great life"

Like is that slander, because I believe it is.

I'm about 99.9% sure that slander needs to be spoken, the situation itself suck-diddly-ux though J. Neutral

Parker: -- that's slander!
JJJ: It is not! Slander is spoken.

No, I am not using this movie quote as the basis of my belief that slander must be spoken.

If it was written it's Libel, if it was spoken it's slander. Either way your buddy is in the wrong if you didn't do anything wrong.

Also his netiquette is atrocious.

He made this claim to the boss and said it to other employees apparently from what 1 told me. I believe it was my ex that replied and not him.

I could care less about being called an asshole and stuff, but when my honesty, integrity is questioned then I get pretty defensive.

I'd say its slander. Or libel. Or whatever.

You need to prove tangible losses in either case. That's usually the most difficult part.

Aye, unless you can prove that, it's not even libel. It's just being a jackass. But that in itself can carry repercussions in the workplace.

No, slander can be written too. So, it's slander.

Your own definition seems to disagree.

"Law. defamation by oral utterance rather than by writing, pictures, etc."

That's the correct definition here.
