The Killer is Roy, but not alone...
Roy, a corrupt officer who repeatedly participated in illegal underground Pokemon fighting rings, was getting very close to those under Mewtwo's influence. He knew he had a gambling problem and his life very quickly went to pieces as he slowly became more violent, more drunk, and generally a worse officer (this change was undoubtedly noticed by the other officers) and he spent more time and money in the ring, gambling. He often bet on the small fry, believing the underdog would save the day and his cash, but he naturally never won. In a fit of rage as he vented all his frustration, Roy killed a Pichu and the one who owned it, stabbing them until they were completely unrecognizable. When Mewtwo discovered this, he decided to use it, knowing full well that Roy would attack him next. When the police examined the remains, he tricked them into believing they were, in fact, Roy's.
When Roy came to kill Mewtwo, the pokemon disfigured him greatly, making him unrecognizable, then used his powers to put Roy into a worsening state of madness, whereupon he killed someone he believed was Mewtwo before stuffing them into a pokeball. The Mafia don then instilled the cadet with the idea that killing all of the dons would fix up the city before unleashing him upon it. Afterward, Mewtwo went into hiding amongst the foreigners, where he used Sonic and Snake as puppets to throw Luigi off of his trail (as he didn't realize that Luigi was actually completely unaware he was still alive.) This is why both Snake and Sonic are completely submissive towards the police when they first walk by, then suddenly openly attacking them.
When Roy was attacking Dedede, Mewtwo knew that his plot would take a bit more than just Roy. He himself manipulated events so that DK and Mario would see each other and fight, as well as having Link set up an interview with the penguin. However, Mewtwo instead put Link in a hypnotized stupor and allowed Roy (who was disguised as Link due to a psychic illusion) into DDD's chambers, where Mewtwo surprised attacked him from behind, and Roy killed him. Mewtwo warped away with his puppet, letting him loose again when they were safely away. The don had actually planned on Roy killing everyone present, but Shiek/Zelda is actually on to Mewtwo and knows he is using Roy, and the raid was simply a means to catch him.
When everyone was caught and thrown in jail, Mewtwo didn't care at first. However, when Red (whom Mewtwo may have seen as a sort of heir) was taken he influenced the minds of the guards and convinced them that moving Kirby to such an insecure facility was a good idea, as he would point the finger at whoever the killer was, knowing full good and well that when Mario attacked the jail the cell would open. He then also used his old cohort, Wario, to surprise Metaknight and kill him with a fire flower (that is, if he didn't do it himself.) Mewtwo then allowed Kirby to go, hoping that it would throw everyone off of Roy's tail.

Considering that the only mention Roy has ever gotten was during the report on his death, I don't think it very likely that he's coming back. The powers that be have said they won't pull a Deuce ex Machina, which would basically be the case if Roy was our butcher.

I'm sticking to my guns. It's metaknight. If they killed off metaknight arbitrarily given how powerful of an entity he is supposed to be, that'd be kinda ridiculous. Then again, the fact that they made Link a sissy in comparison to Mario given that Link had to fight a being with GODLIKE power, and Mario had to jump on top of walking mushrooms, I shouldn't expect much in this regard.

This series is not really about who is powerful enough within the canon of their own game do commit the crime, and more about politics and intrigue. the scene in episode 7 where luigi is talking with kirby, Luigi begins to conclude that the killer must be someone who can weild a sword and make the cuts, but kirby cuts him off and tells him he is going about it the wrong way. Keep in mind also that Mario was the one who captured the cannibal kirby, so in terms of this series he is a powerful entity.

Thanks to those who like my theory. I was surprised that people even paid attention to it. ^^;
But, it makes sense. I mean, there aren't many sensible reasons why someone would want to murder and gut them like that.
As for metaknight, I don't think so. I think I stated this before, but I think his sole purpose was to watch Kirby, to make sure he stayed contained. Without Metaknight, Kirby probably would have easily escaped. Seeing as how Kirby didn't until episode seven (though Metaknight was there) what time would he have to murder these many people? And I don't think he has enough motive to do it, and from what we see of him during the series he seemed plenty sane.
But, it makes sense. I mean, there aren't many sensible reasons why someone would want to murder and gut them like that.

I was looking over the comments on episode 8 over on the escapist website.
Someone mentioned that the fact that Yoshi's head was still there along with his insides was most likely a reference to the Godfather. (The scene where the guy wakes up with the head of his horse in his bed). So I don't think it should be ruled out that Yoshi wasn't killed by the dismemberer.
Also someone mentioned a reference to Silence of the Lambs and how Hannibal escaped by taking the face of the guard and using it as his own and pretending to be injured. I think this is also very likely what Kirby may have done to Meta Knight.

I think Yoshi's head being there, besides the Godfather reference, is so that Mario knows for a fact who the guts belong to. If it was just a pile of gore, he might believe them to belong to Peach, or even to Luigi. But by including the head, Mario knows for certain who the remains belong to.
So ask yourself...why did the killer want Mario to know that the remains were Yoshi's? Was it just a warning? Or does the killer want Mario to know that Peach is still alive?

Well, I'm thinking due to the uprise Mario caused, banning everyone together, he made himself even more enemies. Maybe this is the killers way of telling him to back off?
